The following are the terms and conditions governing the use of the website and other means of customer service, both technological and in-person, of Intiflats Cusco. This platform, accessible through the URL https://intiflatscusco.com, is intended to market accommodation services in the city of Cusco.
For the purposes of this document, "User" means any natural or legal person (company) who accesses the website or other means of customer service of the company to obtain information or contract any of the services offered therein.
Obligation to Read and Accept the Conditions
Before proceeding with their reservation, guests and/or users must read, understand, and accept the general terms and conditions set forth below. They must also review the additional information and specific terms and conditions of the service they wish to book or purchase.
The user's express consent is formalized by selecting the "I have read and accept the general conditions" box, which appears throughout the hosting services contracting process.
Services Offered
Intiflats Cusco offers accommodation services in private apartments, either for the entire apartment or by room. Services can be booked through the website or through other means provided by the company.
Specific Conditions Due to COVID-19
The health conditions, restrictions, and regulations related to the tourist accommodation service offered by Intiflats Cusco are those in effect at the time of reservation acceptance.
However, guests are informed that these conditions may vary between the reservation date and the arrival date, due to the evolving health situation and the provisions issued by the Peruvian authorities. Guests are advised to periodically consult official sources to stay up-to-date on health requirements, mobility restrictions, or obligations for entering the country, such as the official Peruvian Government website: https://www.gob.pe/coronavirus As part of health protocols, guests may be required to complete a Health Control Form to enter Peru. This form generates a mandatory QR code that may be requested at checkpoints upon arrival. The form is available at: https://bit.ly/3IvPZ6M Liability: Intiflats Cusco is not responsible for cancellations, changes, or inconveniences arising from the guest's failure to comply with these health provisions.
Services and Conditions for the Rental of Apartments and Rooms
Intiflats Cusco acts as a direct provider of tourist accommodation services, offering apartments and rooms for rent to travelers and/or businesses.
The information provided regarding accommodations, included services, rates, and conditions is subject to change and updates based on availability and current regulations.
For other related services, such as transportation or excursions, Intiflats Cusco acts as an intermediary between the guest and the providers of said services, and assumes no responsibility for changes or cancellations beyond its control.
Required Information for Reservations
To ensure proper booking management, the guest must provide:
• Full names and surnames
• Nationality
• Valid passport and/or ID number
• Birthdate
• Gender
Reservation Confirmation
Confirmation will be sent by email to the registered address within 48 hours of receiving the reservation and deposit payment. The reservation will only be effective upon receipt of payment.
Deposit and Payments
Full payment must be made at least 15 days before check-in.
Guest Responsibilities
• The guest is responsible for providing valid contact information and reviewing their confirmation.
• All rates are subject to availability and may vary depending on season and demand.
Use and rules of the accommodation:
Guests must comply with the accommodation's internal rules to ensure a comfortable and safe stay.
It is strictly prohibited:
• Holding parties, unauthorized meetings, or making annoying noises.
• Making noise or loud noises between 10:00 p.m. and 7:00 a.m.
• Allowing unregistered persons to enter the apartment.
• Using drugs or smoking in closed areas of the apartment (fine of USD $250).
In case of non-compliance, a fine of USD 250 will be applied.
Additionally, the Peruvian National Police will be notified, in accordance with current legislation. Furthermore, the offender is subject to administrative sanctions for smoking in enclosed spaces, which may amount to S/. 360 (0.1 Tax Unit) per offense.
• Modify, move or damage furniture, appliances or locks.
• Prohibition on moving or changing furniture and appliances
It will be specified that it is prohibited to relocate, move, or replace furniture (mattresses, cabinets, tables), appliances (washing machine, refrigerator, stove), or other items in the apartment without prior authorization.
• If the guest alters the layout or damages any property, the cost of repair or replacement will be charged directly to their account.
Unauthorized Stay:
The guest acknowledges that the accommodation is only for the days paid for.
• You cannot remain there longer without prior authorization and payment.
• Any attempt to occupy the property by force or without prior agreement will result in immediate removal by Intiflats Cusco.
• The guest's account will be charged the total amount of losses and logistical expenses incurred, including reservation rescheduling, security services, and administrative costs.
• This provision is supported by Article 1029 of the Peruvian Civil Code, which establishes that the rights of use and habitation are personal, temporary, and cannot be extended without the owner's consent.
Property damage clause:
• Any damage to the property, furnishings, or facilities will be charged to the responsible guest's account, including repair, replacement, and logistics costs.
Cancellations and Refunds
• No Show: 100% Penalty.
• Cancellations with less than 15 days: 100% penalty.
• Between 16 and 31 days: Penalty 30%.
• More than 32 days: 20% penalty.
Documentation and Insurance
Guests must meet the passport, visa, and vaccination requirements mandated by Peruvian authorities. Travel insurance covering accidents, medical expenses, cancellations, repatriation, and lost luggage is recommended.
Luggage and Meals
• Free storage service for 3 hours (additional time at a cost).
• Food preparation permitted in designated areas.
• Professional chef service available at an additional cost and by prior arrangement.
Responsibilities of Intiflats Cusco
In the event of administrative errors attributable to the company, alternative accommodation or a proportional refund for the service not provided will be offered.
Force Majeure
In the event that the provision of the service is affected by force majeure such as:
Natural disasters, Strikes or blockades, Pandemics or health crises, Border closures, Transportation disruptions, and other causes beyond the control of Intiflats Cusco.
No habrá obligación de reembolso total. Sin embargo, Intiflats Cusco podrá evaluar cada situación y, dependiendo del caso, ofrecer un reembolso parcial de hasta el 50% del monto pagado, siempre que existan razones debidamente justificadas y documentación que respalde la solicitud del huésped. La decisión final quedará sujeta a la valoración de la gerencia de Intiflats Cusco y a la disponibilidad financiera y operativa de la empresa.
Limited Liability
Intiflats Cusco will not be responsible for:
• Loss of personal belongings.
• Third-party services such as transportation or excursions.
• Damage caused by guest negligence.
Protection of Personal Data
The provisions of Peruvian Law No. 29733 on the Protection of Personal Data will be complied with. Guests may request rectification or deletion of their data by written communication.
Policy of Conduct and Respect for the Community
Any act of violence, discrimination or illegal activities within the accommodation is prohibited.
Dispute Resolution
Disputes will be resolved amicably. If no agreement is reached, the competent jurisdiction will be Cusco, Peru.
Modification of Terms
Intiflats Cusco may modify these terms with prior notice on its website or by email to registered guests.
